I work to be a freelance web artist and employ the skills of a databasing gentleman. I have a person who is scolding up a publicity, wanting a copy in the site and the MySql database intended for backup… This wasn’t pre-arranged and also though we would like to give them a copy from the site, my databasing male is unwilling to spend the database (which I types of agree with).. He says he has offered a assistance, NOT a solution..
Whats ordinary with web layout firms. Do they normally spend the database which has been designed through scratch I don’t even think so but maybe you’ll be able to prove me wrong!!
Responses please……
many thanks alot
If the client paid to the development effort, it really is arguable whether your inventory is his. The software (which WE assume you include in " database" ) needs to be licensed to your client either as an ASP (application company provider) agreement by which you host the software and allow we to use it throughout a period in which he pays people a recurring " service fee" or to be a software sale, by which you give your ex the database, software program, and design, and he then has the correct to use (but to not sell or redistribute) the software at the discression. If he given you upfront for the whole thing, you gave him cost-free option. You can’t force him now to use you for hosting in addition.
Direction, he has a to a backup on the database, because it contains information highly relevant to his business. The information (meta-data) stored inside database is POSSIBLY NOT your intellectual property. You cannot legally keep it out of him.
Well if he’s trying for the data, that you’d have got to give him, because it’s his facts. As for the particular code behind the construction from the database (i. e. CREATE blah blah) what a tough one for you to answer.
Also it depends on how complicated the overall site is. Is it a little something that if EVERYTHING a part of it was bundled it could be re-sold to somebody else I. E. vBulletin or maybe InvisionBoard
Heh… bummer of an situation, but WE suppose it gets ya to knowing a lesson. I ensure that the client understands that everything i’m executing is theirs really like pay me. We have no reason to help keep anything really. I suppose merely made something that required a huge selection of hours of work and can easily be resold for thousands I might own issues… But generally I prefer o make the idea clear that everything I do they’re just entitled to. You should make up a policy similar to this in your proposal and allow it to become very clear no matter what your stance on this subject is.
